A class member had to satisfy one of two conditions: their number was registered with the National Do-Not-Call Registry more than 31 days before the calls and they were not a self-paying subscriber, or they had asked to be placed on Sirius XM's internal do-not-call list.

Why did the calls have to number more than one?

The federal do-not-call rules give a private right of action for more than one solicitation call within a 12-month period. A single call does not meet that threshold, which is why the class definition counts calls rather than simply asking whether the number was on the registry.

What is an internal do-not-call list?

A company must keep its own record of people who have asked it to stop calling, separate from the national registry. Asking to go on that internal list creates a claim even for someone who never registered nationally, which is why the class definition offered two routes in.
