What was the case about?

Website tracking on a health system's pages. Analytics and advertising code embedded in those pages can report what a visitor looked at to third parties, and on a hospital site the pages a person reads can themselves suggest a medical condition, which is what puts the disclosure at issue.

Was proof required?
