What this settlement covers

You paid an unreimbursed surcharge to withdraw cash from an independent ATM in the United States with an ATM or PIN-debit card between October 24, 2007 and August 14, 2026.

The nationwide class covers people in the United States who were charged a surcharge, also called an access fee, to withdraw cash from a deposit account at an independent ATM in the United States or its territories between October 24, 2007 and August 14, 2026, and were not fully reimbursed by their bank. Statewide classes also cover California, Illinois, Massachusetts, and Michigan. The withdrawal has to have been made with an ATM or PIN-debit card. Credit card transactions, cash advances, and prepaid or gift cards are not included. The case is Burke v. Visa Inc., No. 1:11-cv-01882, in the United States District Court for the District of Columbia.

What you can claim

  • A proportional share of the net $167.5 million settlement fund, based on the number of qualifying surcharged withdrawals that are approved.

How payment works

Visa and Mastercard pay $167.5 million into the fund, $88,775,000 from Visa and $78,725,000 from Mastercard. Attorneys' fees of up to 30 percent, notice and administration costs of up to $3 million, taxes, and service awards of up to $17,500 for each class representative come out first. What remains is the net fund. Each approved claim gets a proportional share of that net fund, weighted by the number of qualifying withdrawals the administrator accepts. A proportional share means the payment rises or falls with how many people file and how many withdrawals they claim, so the notice says nobody can know the amount in advance. Payment is sent by email. When the notice arrives you pick a digital option such as PayPal or a virtual debit card, or you can ask for a paper check. Nothing is paid until the court approves the settlement.

ATM surcharges Class Action Settlement FAQs

Common questions about this class action settlement.

Who can file?

People in the United States who paid a surcharge, also called an access fee, to withdraw cash from a deposit account at an independent ATM between October 24, 2007 and August 14, 2026, and whose bank did not fully reimburse that fee. An independent ATM is not owned by Visa, Mastercard, or any bank or other financial institution. The withdrawal has to have been made with an ATM or PIN-debit card. Credit card transactions, cash advances, and prepaid or gift cards do not count. Separate statewide classes also cover California, Illinois, Massachusetts, and Michigan. The case is Burke v. Visa Inc., No. 1:11-cv-01882.

How much is the payment?

A proportional share of the net $167.5 million fund. Visa pays $88,775,000 and Mastercard pays $78,725,000. Attorneys' fees of up to 30 percent, notice and administration of up to $3 million, taxes, and service awards of up to $17,500 per class representative are deducted first. The rest is divided among approved claims in proportion to the number of qualifying withdrawals each person claimed. The official notice says nobody can know a payment in advance, because it depends on how many valid claims and withdrawals are approved. There is no published per-person amount.

Do I need a receipt?

No. The claim form says you do not need to provide any documentation at this time. You estimate how many unreimbursed independent-ATM withdrawals you made with an ATM or PIN-debit card during the class period, as a whole number of up to four digits, and you sign under penalty of perjury. The claims administrator can later ask for bank statements or other documents to support the claim. Filing does not require you to upload a receipt.

When is the deadline?

The claim form must be submitted online at NonbankATMSurchargeSettlement.com by February 10, 2027, or postmarked by that date. Mail it to Non-Bank ATM Surcharge Fee Settlement, c/o A.B. Data, Ltd., P.O. Box 173053, Milwaukee, WI 53217. Questions go to the administrator at 1-866-893-1052 or info@NonbankATMSurchargeSettlement.com. The court hearing on final approval is set for February 17, 2027. Payments are made only if the court approves the settlement and any appeals are resolved.

What am I signing?

The certification says, under penalty of perjury, that the information on the form is accurate and complete to the best of your knowledge, that you are a class member or authorized to submit the form for one, and that you did not opt out of the settlement with Visa and Mastercard. You also agree to be contacted by email and text about the payment, and to provide more information if the administrator asks. Filing releases the claims described in the settlement agreement and the long form notice, both on the settlement website.

I filed an earlier ATM fee settlement. Does this replace it?

No. The long form notice describes two earlier, related settlements, one approved on August 22, 2022 for $67 million and one approved on June 20, 2025 for $197.5 million. Those covered bank ATM surcharges. This settlement is Burke v. Visa Inc. and covers unreimbursed surcharges at independent ATMs, which are machines not owned by a bank. Filing a claim here does not change whatever you did in those earlier cases, and a claim you already filed there is not a claim in this one.
